1. Introduction

Welcome to Hypnotherapy Berkshire (“we,” “us,” or “our”). These Terms of Service (“Terms”) govern your use of our website at www.hypnotherapyberkshire.com (the “Site”) and all related services, including:

• In-person hypnotherapy, coaching, and massage sessions

• Digital hypnosis audio products and subscription services offered under our sub-brand Premium Hypnosis Audios

By accessing or using our services, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use our services.

We may update these Terms from time to time. Updates will be posted on this page with the revised effective date. Continued use after changes take effect constitutes acceptance of the revised Terms.

2. Eligibility

• You must be at least 18 years old to book sessions or purchase hypnosis audio products.

• If you are 16 or 17, you may use the services only with the consent of a parent or legal guardian.

• By using our services, you confirm you have the legal capacity to enter into these Terms.

3. Appointments and In-Person Services

• Sessions must be booked in advance.

• Cancellations or rescheduling should be made with at least 24 hours’ notice; missed appointments without notice may be charged in full.

• We may refuse service where there are contraindications, safeguarding concerns, or where the service is not appropriate.

• We may suggest referral to another professional where suitable.

4. Purchases, Subscriptions, and Billing (Digital)

4.1 Purchases
When you purchase a hypnosis audio or related digital content, you receive a personal, non-exclusive, non-transferable licence for your own individual use.

4.2 Subscriptions
Subscriptions renew automatically at the end of each billing period unless cancelled before renewal. By subscribing, you authorise us (via Stripe or PayPal) to charge your chosen payment method on a recurring basis until you cancel.

4.3 Cancellation
You may cancel your subscription at any time through your account settings or by contacting us. Access continues until the end of your current billing period.

4.4 Refunds

• Digital downloads: All sales are final and non-refundable once accessed or downloaded, except where legally required (for example, if a file is faulty).

• Subscriptions: No refunds for partially used billing periods.

• In-person services: No refunds for completed appointments; rescheduling may be offered at our discretion.

5. Acceptable Use

You agree not to:

• Copy, share, resell, upload, or distribute any hypnosis audio content beyond your personal use

• Attempt to gain unauthorised access to our systems or interfere with the Site

• Upload malicious code, spam, or unlawful content

6. Medical Disclaimer

Our services and hypnosis audios support relaxation, wellbeing, and personal development. They are not a substitute for medical, psychological, or psychiatric advice, diagnosis, or treatment.

• Do not use hypnosis audios while driving, operating machinery, or in situations requiring full attention.

• If you have epilepsy, a diagnosed mental health condition, are pregnant, or are under clinical care, consult a qualified healthcare professional before use.

• Use of our services is at your own risk.

7. Intellectual Property

All content, including audio files, scripts, images, branding, and website content, is owned by Hypnotherapy Berkshire and Premium Hypnosis Audios or our licensors. Your purchase grants a limited personal licence only. You may not reproduce, share, sell, distribute, or otherwise exploit our content without written permission.

8. Availability

We aim to provide uninterrupted access but do not guarantee that services will always be available or error-free. Services may be unavailable during maintenance, updates, or events beyond our control.

9. Warranties and Limitation of Liability

9.1 Warranties
Services and content are provided “as is” and “as available” without warranties of any kind, express or implied.

9.2 Limitation of Liability
To the fullest extent permitted by law, we shall not be liable for:

• Loss of data, income, profits, or business opportunities

• Any indirect, incidental, or consequential damages

• Any amount exceeding £500 or the total you paid in the 3 months before the claim, whichever is greater

Nothing in these Terms limits liability where it would be unlawful to do so, including for death or personal injury caused by negligence or for fraud.

10. Indemnity

You agree to indemnify and hold harmless Hypnotherapy Berkshire, its directors, employees, and partners from any claims, damages, or expenses arising from your misuse of the services or breach of these Terms.

11. Governing Law and Jurisdiction

These Terms are governed by the laws of England and Wales. You agree that any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
